asbestos construction
Is this grounds for legal action?

My fiance worked 9 hours of overtime and his boss won’t pay him for it. He’s supposed to get $15 an hour for overtime.

This man owns a construction company and he sends people to work with asbestos and lead paint without telling them and a lot of the workers have babies, including us. He sends his workers to his house to clean his garage and basement and rake his leaves and his son’s as well. I know that he is not allowed to do these things unless he lists himself as a customer and pays for it, and he doesn’t.

There’s a lot of bad things about this company and I’m just wondering if this would be grounds for legal action. I probably wouldn’t pursue it, just threaten so that my fiance gets paid what he deserves
New York State

As to the leaf raking etc – as long as they are paid they are on company time – they
work where ever they are sent – that is not illegal at all

The overtime procedure is prescribed by federal law – over 40 hours a week is considered
overtime – the local hour and wage board in your locality can handle this without any
law suit involved.

The asbestos situation is a completely different story altogether – this should be
reported to the Federal OSHA or to the local health department in your area -
This is dangerous and a violation of Federal & State Laws which is very strict
as how to handle asbestos – you need to report this immediately.
